ARTICLE 1: SCOPE AND ACCEPTANCE OF GENERAL TERMS OF SALE

1.1. SCOPE These general terms of sale apply to all sales made through the website https://keyfero.com (hereinafter referred to as the "Site").

KEYFERO products are exclusively intended to be sold to end consumers, both individuals and legal entities, excluding all resellers or intermediaries acting on behalf of resellers. Therefore, the customer affirms that they are acting as an end consumer and do not intend to resell KEYFERO products for commercial purposes.

KEYFERO may at any time and without notice update these General Terms of Sale. You can view the current version of these General Terms of Sale at any time by clicking on the "T&Cs" link located at the bottom of the page. The General Terms of Sale in force at the time of the conclusion of the sales contract are the ones applicable to you.

1.2. ACCEPTANCE OF THE GENERAL TERMS OF SALE The buyer expressly agrees to and accepts these General Terms of Sale and the rates, declares and acknowledges having perfect knowledge of them, and thereby waives the right to rely on any contradictory document, particularly their own general terms of purchase. The act of purchase entails acceptance of these general terms of sale.

 

ARTICLE 2: ORDER TERMS

The Site allows you to order a selection of products (hereinafter the "Product(s)") from KEYFERO online immediately via the Internet for delivery to mainland France.

The Site does not allow special orders, which include the creation of a Product not currently or no longer in the KEYFERO collection, or the adaptation or customization of a Product from the KEYFERO collections, and its manufacture by KEYFERO. Therefore, these General Terms of Sale do not apply to special orders. For any special order, please contact our Customer Service by clicking on the "Contact" link located at the bottom of the page.

Automatic registration systems are considered as proof of the nature and content of the order. KEYFERO confirms the acceptance of its order to the customer at the email address that the customer has communicated. The sale will be concluded as of the validation by KEYFERO of the payment of the order, that is, from the date of validation of the payment for orders paid online by credit card.

KEYFERO reserves the right to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

 

ARTICLE 3: PRODUCT AVAILABILITY

As long as our offers and their prices are visible on the site, they are valid. The availability indicated at the time of consultation of the site by the customer remains dependent on the state of the stock at KEYFERO and of course at the suppliers. Errors or modifications can exceptionally exist, particularly in the case of simultaneous orders of the same Product by several customers.

To create our storefront and sales catalog, we work with databases, enriched according to the information provided by our suppliers. This database contains more than a hundred articles, not all of which are stored in our reserves, and our offer is then conditioned by the availability of the articles at the suppliers.

Only the definitive unavailability of an article at our suppliers leads to its removal from our sales offer. In other cases, a new order within a certain period remains possible.

In the event of unavailability of a Product after placing your order, we will inform you by email as soon as possible, offering you either to order another Product presented on the Site as a replacement or to cancel your order.

KEYFERO is not liable for out-of-stock or unavailability of Products for orders not yet accepted by KEYFERO.

KEYFERO reserves the right to change the Products offered on the Site at any time and without notice. To ensure better quality of service and availability of our Products to all customers of the Site, KEYFERO reserves the right to limit the quantity of Products that can be purchased by a customer, in accordance with applicable provisions, particularly those of Article L122-1 of the French Consumer Code.

 

ARTICLE 4: ORDER PROCEDURE

4.1. Product Selection At any time, you can add Products to your selection by clicking on "Add to Cart", and choose to complete your purchases or continue your browsing.

You can view your selection by clicking on the cart in the ad hoc menu, which will display: the photo(s) of the Product(s), its name(s), features, the chosen quantity(ies), its unit price(s), the subtotal of the selection, the shipping costs for mainland France, and the total price of your order including delivery.

4.2. Identification If you already have a customer account, you will need to identify yourself at this stage by entering your email address and password.

If you do not have an account yet, you can continue your purchase as a guest by entering your email address.

Your login details and passwords are strictly personal, consequently, you commit to keeping them secure and never communicating them to third parties. KEYFERO cannot be held responsible for any loss, theft, or fraudulent use of your customer account, in which case you commit to immediately informing KEYFERO.

Creating an account allows you to:

Track your deliveries and view your order history; Add or modify your delivery and billing addresses for future orders; The data recorded by the Site constitutes proof of all transactions between KEYFERO and its customers. In the event of a dispute between KEYFERO and one of its customers on a transaction made on the Site, the data recorded by KEYFERO is considered valid proof of the content of the transaction.

You can deactivate your account at any time by sending an email to the Customer Service by clicking on the "Contact" link. After deactivating your account, you are free to create a new account at any time.

4.3. Order Validation

4.3.a) Validation of the delivery method

You must complete the delivery information necessary for the proper shipment of your order: country of shipment, title, first name, last name, phone number, delivery address.

You can use your delivery address as the billing address or enter another one. You will then be invited to select a payment method and enter the corresponding information.

Once this step is completed, click on "validate".

4.3.b) Validation of the payment method and settlement of the order

At the end of the ordering process described above and after having accepted the entirety of these General Terms and Conditions of Sale and Use and the Return/Refund Policy, click on the "Place my order" button. The sales contract will then be definitively formed.

You must check the accuracy of your selection before confirming your order. While all efforts are made to ensure that the color and pattern of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, particularly due to the technical limitations of color rendering on your computer equipment. Consequently, KEYFERO cannot be held responsible for errors or non-substantial inaccuracies in the photographs or graphic representations of Products appearing on the Site.

Once completed, your order is transmitted to KEYFERO for processing.

KEYFERO reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if KEYFERO reasonably believes that this customer has violated these General Terms or engaged in fraudulent activity, or for any other legitimate reason.

4.3.c) Order Confirmation

A summary of your order will then be sent to you by email. The acknowledgment of receipt will show the total amount of the order, information related to the cost of delivery, the essential characteristics, the quantity, and the price of the Products purchased.

We advise you to keep this acknowledgment of receipt on paper or electronic support.

 

ARTICLE 5: PRICES - ACCEPTED MEANS OF PAYMENT

5.1. Prices The prices indicated in euros are deemed net, excluding shipping costs. This price includes the price of the products, handling, packaging, and storage costs. They are subject to change at any time without notice, knowing that the articles will be invoiced on the basis in force at the time of registration of the order. All orders are invoiced in euros and payable in euros. Any customs fees or local taxes remain the responsibility of the recipient.

5.2. Payment You can pay by credit or private card (Visa, Eurocard/Mastercard) directly on the site, in the payment form offered during the order process (secure entry by SSL encryption), by entering the type of card, the number of your card without spaces between the digits, the control number (located on the back of your card) and the validity date.

Payment is made at the choice on the secure banking servers of our partners. This implies that no banking information concerning you is transmitted via the site https://keyfero.com.

Credit card payment is therefore perfectly secure; your order will thus be registered and validated as soon as the payment is accepted by the bank.

 

ARTICLE 6: DELIVERY TERMS

6.1. Address and Delivery Area

We deliver to your home or to a pickup point. Products purchased on the Site are delivered by postal service (Standard Home mode):

In Europe: France (including Corsica), Belgium, Réunion, Guadeloupe, Martinique, Mayotte, Saint-Martin, Luxembourg, Monaco Worldwide Products are shipped to the delivery address you indicated during the ordering process.

6.2. Delivery Times The delivery time includes the time to prepare the package plus the time for transportation. KEYFERO delivers worldwide. The buyer is notified by email of the different stages of their order tracking: preparation and delivery.

The delivery time includes the time for preparation and the delivery by our carrier. The announced delivery time of 10 to 25 days is valid from the receipt by the buyer of the email dispatching the order. The delivery time (announced by the carrier) does not commit KEYFERO to a longer time frame.

Delivery deadline of the order: during the ordering process and on the order acknowledgment receipt, a delivery time is communicated to customers. It is calculated by adding the longest product availability time to the delivery time of the transport mode selected by the customer. From the placement of the order to its dispatch, the customer has the possibility to cancel their order.

6.3. Transport Costs The amount of the delivery fees is calculated based on the chosen Products, the total value of your order, the delivery area, and the selected delivery mode.

The transport costs include a contribution to the costs of preparation, packaging, and postage. Remember to group all your items in one order. We will not be able to group two separate orders, and shipping costs will be charged for each of them.

 

ARTICLE 7: DELIVERY PROBLEMS

Any defect or delay in delivery must be reported to our Customer Service as soon as possible. Any complaint made more than 14 calendar days after the receipt date of your order will not be considered.

In case of non-compliance with the delivery time, you can cancel the order simply by email.

KEYFERO will then be required to refund all sums paid, no later than fourteen (14) days following the date of denunciation of the sales contract. If you still receive the Product after using this option, you must return it according to the return procedures provided in article 8 below.

You must check the conformity of the Products at the time of delivery and indicate, if possible on the delivery slip, in the form of handwritten reservations accompanied by your signature, any anomalies noted (open package, damaged Product, etc.).

 

ARTICLE 8: RIGHT OF WITHDRAWAL - RETURNS, EXCHANGES, REFUNDS

8.1. Right and Withdrawal Period

The items provided by KEYFERO are new and guaranteed against any defect. They are identical to those in traditional commerce and come from all the publishers and suppliers listed.

If it happens that an item is defective or non-compliant, the buyer has 14 working days, from the receipt of the items, to request an exchange or a refund. If the fourteen (14) day period normally expires on a Saturday, Sunday, or a public holiday, it is extended until the first following working day.

The customer must return the new articles in their entirety and in their original packaging, intact, accompanied by all possible accessories, instructions for use, and documentation (in its original cellophane packaging and with the corresponding invoice). In such a situation, the buyer must send proof of the defect(s) to support@keyfero.com (description and photos attached).

In case of exercising the right of withdrawal, KEYFERO is required to refund the sums paid by the customer, without charge, except for the return costs. The refund is due within a maximum of 14 working days from the date of receipt of the returned package(s).

Outside of cases of refund made within the framework of the exercise of the right of withdrawal or for lack of conformity and hidden defects, KEYFERO will not refund the VAT applied to purchases made on the Site (even in the case where the buyer, after receipt, resends the Products to a country outside the European Union).

Return shipping costs remain your responsibility.

In case of a refund, we guarantee that it is made within a period less than or equal to 14 days following the date of receipt of the returned package. No COD shipment will be accepted, whatever the reason.

We do not proceed with exchanges of items, except if they are defective or damaged. If you want a different size, you will need to reorder at https://keyfero.com.

 

ARTICLE 9: RETURN, EXCHANGE, AND REFUND PROCEDURES

9.1. Return

Within the framework of exercising the right of withdrawal and to be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Non-returnable items:

  • Gift cards To complete your return, we need a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

9.2. Exchange

We only replace items if they are defective or damaged. In the aforementioned case, we invite you to contact our Customer Service via the "Contact" tab located at the bottom of the page.

9.3. Refund

In the case of a refund request, this will take place, according to the legislation, fourteen (14) days from either the receipt of proof of shipment of the Product(s), or the receipt of the Product(s), the date retained being that of the first of these facts. The refund, including the standard delivery costs of the initial order, will then be made using the same payment method used during the order.

Please note that an additional delay may be applied by your bank during the refund.

Once your return is received and inspected, we will send you an email to inform you that we have received your returned item. We will also inform you of the approval or rejection of your refund.

 

ARTICLE 10: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS

The transfer of ownership of the products to the buyer will only be carried out after full payment of the price by the latter, regardless of the delivery date of said products. However, the transfer of the risks of loss and deterioration of the products will be carried out upon delivery and receipt of said products by the buyer.

 

ARTICLE 11: PROTECTION OF YOUR PERSONAL DATA

KEYFERO is the producer and owner of all or part of the databases composing this site. By accessing this site, the customer acknowledges that the data composing it are legally protected and, in particular, refrains from extracting, reusing, storing, reproducing, representing, or keeping, directly or indirectly, on any type of support, by any means and in any form whatsoever, all or a qualitatively or quantitatively substantial part of the content of the databases appearing on the site to which they have access.

 

ARTICLE 12: LIABILITY

The descriptions of products present in the databases of https://keyfero.com have been entered based on information provided by publishers. KEYFERO is not responsible for the content of the works and cannot be held liable to the buyer. KEYFERO's liability cannot be sought in the event of the occurrence of a force majeure event (strike, flood, fire...).

The products offered comply with current French law. KEYFERO declines all responsibility if the delivered item does not comply with the legislation of the country of delivery (censorship, prohibition of a title or an author...). KEYFERO is not responsible for the content of websites to which hyperlinks may refer from its own site.

In no case can KEYFERO's liability be engaged for any damage that does not result from a failure of KEYFERO to one of its obligations.

 

ARTICLE 12: APPLICABLE LAW - DISPUTES

These General Terms of Sale are governed and interpreted in accordance with French law. However, in accordance with EC Regulation 593/2008 of 17 June 2008, these General Terms of Sale do not prevent compliance by KEYFERO with a more favorable provision to the customer and which cannot be derogated from by agreement, under the law where the customer has their habitual residence.

In the event of a dispute related to the execution of an order, you have the possibility to resort to a conventional mediation procedure or to any other alternative dispute resolution procedure.

These General Terms of Sale are written in English. Notwithstanding the foregoing, in the event of a dispute, in accordance with Regulation No 44/2001 of 22 December 2000:

You may seize either the court of the place where you are domiciled, or the French courts; KEYFERO may seize the court of the place where you are domiciled.
